The 38-year-old did not appear in person when his case appeared in Bega Local Court on Tuesday, November 10, as his lawyer Jennifer Chalker said "he has a medical appointment".

In the courtroom, Magistrate Doug Dick confirmed nine Commonwealth charges were to be withdrawn from the case as it was no longer a matter for the Commonwealth Department of Public Prosecutions and was reverting to the NSW Police.

He said the Commonwealth charges were to be replaced with two counts of producing child abuse material and seven counts of possessing child abuse material.

Police prosecutor Sergeant John de Laroche questioned whether or not the matter would be referred to the NSW Department of Public Prosecutions, but later Magistrate Dick confirmed it would remain with the prosecutor.

Ms Chalker said the accused had not yet instructed her how he would plead, and Magistrate Dick adjourned the matter to November 24 for pleas to be entered.

Under the charges the man faces a maximum penalty of 10 years' prison.
