A MAN convicted of sexual intercourse without consent has been handed a suspended sentence.
John William Morehouse, 58, of Batemans Bay pleaded guilty to the charge and was sentenced at Bega District Court on August 12.
A police report stated on January 27, 2015, Morehouse visited the residence of a female friend in Moruya, where they watched television while sitting on a lounge.
Morehouse had already consumed beers prior to going to the residence and while at the residence he consumed more beer.
The female resident later fell asleep under a blanket on the lounge.
While she was asleep, Morehouse rubbed his friend’s lower leg and inner thigh before removing her underpants.
He inserted his finger into her vagina for less than a minute.
When the female woke up, she realised her underpants had been removed.
She went to the bathroom and, after feeling pain while urinating, returned to the lounge room and told Morehouse to leave, which he did.
The female reported the incident to the police on January 30, who several days later interviewed Morehouse.
During the interview, he admitted to the incident.
At Bega District Court, Judge Cogswell SC sentenced Morehouse to 22 months’ imprisonment, but suspended it for the total period.
Morehouse was released from custody on the condition he enter into a good behaviour bond for 22 months.
His charge carries a maximum penalty of 14 years’ imprisonment.
