Batemans Bay Local Court on Monday, October 28, heard a guilty plea was likely to be offered to a reduced charge of manslaughter against Warren Anthony Scott, 36 years, of Bega.
Defence solicitor John Edmunds told the court that possibility had been discussed the previous Friday in a conference with the prosecution.
He told the court a manslaughter charge was likely due to his client's "substantial impairment" and a guilty plea could be offered. However the prosecution could not agree until further medical reports were completed.
Brett Diggins, for The Office of the Director of Public Prosecutions (DPP), said the DPP would also seek a further psychiatric evaluation.
Scott has been in custody since his arrest in April, 2019 and appeared via audio-visual link.
Magistrate Doug Dick refused bail and adjourned the case to December 9.
