The aim of the scheme is to prevent domestic violence (DV) by warning potential victims of their partner’s history of DV offending.
The NSW Domestic Violence Disclosure Scheme is similar to the UK’s Clare’s Law, which was introduced in 2012 after a woman was murdered by her partner shortly after contacting police, who were unable to disclose anything about his history.
Under the scheme, if someone is worried about their own safety, they’ll be able to apply to NSW police for information about their partner, or their former partner in certain circumstances.
The person in need of the information must be an Australian resident, aged 16 years or over, and live in a local area command that is operating the scheme.
The Domestic Violence Disclosure Scheme has the potential to improve the safety of people in domestic relationships with the partners who have a history of domestic violence.
It allows people to make informed decisions about their safety, to seek assistance or undertake safety planning, or decide whether to remain in the relationship.
Under the DVDS pilot, a person who has concerns about their partner is able to make an application to NSW police to check if their partner has a history of domestic violence.
A third party can also ask for a disclosure to be made to the primary person where they have concerns for their safety and some form of contact with the primary person.
