Magistrate Doug Dick has threatened to subpoena a pathologist in the case of a Bega woman accused of murdering 26-year-old Marnie Lee Cave after it was revealed a report is yet to be received.

Rosemary Priscilla Mackie faced Bega Local Court on Tuesday, May 24 via AVL from Silverwater Correctional Complex, before the case was adjourned to Batemans Bay Local on Friday, May 27 to allow time for the report.
A shortage of resources was blamed for the delay by Director of Public Prosecutions solicitor Brett Diggins, who said the report is required to fully understand the cause of Ms Cave’s death.
Mr Diggins described “two acts of violence” on the victim and it was revealed Ms Cave suffered a broken clavicle and skull as well as strangulation on the night of her murder.
“If there is no report I will be listing it for a committal hearing,” magistrate Dick advised Mr Diggins.
Mackie is charged with murder and wounding with intent to cause grievous bodily harm after she was arrested on December 1 last year at a property in Bega almost seven weeks after Ms Cave’s body was found by campers under Mogareeka’s Handcocks Bridge, near Tathra, on October 14.
Ms Cave's handbag and phone were missing but she was wearing a distinctive butterfly pendant necklace. In the days after her death, police released a photograph of that necklace in a bid to identify her.
